In-house counsel and attorneys on both sides of the bar are adept at negotiating class action settlements. More frequently, however, counsel are also starting to consider what happens after a class action settlement is reached. That is, they are asking us about more details of the administration up front and no longer just assume that whichever administrator they hire will “handle it.” That is a good trend, because administration issues are becoming more important to the actual settlements than ever before.
