On August 17, 2004 Saltire Industrial, Inc. (the "Debtor") filed a voluntary petition for reorganization under Chapter 11 of the United States Bankruptcy Code. The Debtor filed in the United States Bankruptcy Court for the Southern District of New York (the "Bankruptcy Court"). The case is administered under case number 04-15389 assigned to the Honorable Burton R. Lifland.

The Bankruptcy Court set December 10, 2004 at 5:00 p.m. Eastern Time as the deadline for filing proofs of claim (the "Bar Date"). Creditors holding any claim against the Debtor that arose prior to August 17, 2004 were required to deliver a completed and signed original proof of claim, together with accompanying supporting documentation, at the following address:

Proofs of claim were deemed filed only if they were received by the Bankruptcy Court on or before the Bar Date.

On December 28, 2005, the Debtor filed with the Bankruptcy Court its Modified First Amended Chapter 11 Plan of Liquidation (the "Plan") and its Modified First Amended Disclosure Statement relating to the Plan (the "Disclosure Statement"). The Disclosure Statement was approved by Order dated December 28, 2005. On March 8, 2006, an order was entered confirming the Debtor's Plan.

On March 8, 2006, an Order was entered Confirming the Modified First Amended Plan of Liquidation of Saltire Industrial, Inc. under Chapter 11 of the Bankruptcy Code.
