On September 5, 2003, MGNH, Inc. and HCA Genesis, Inc. d|b|a Mercy of Northern New York filed voluntary petitions for reorganization under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Southern District of New York. The cases are jointly administered under lead case number 03-37133, and are assigned to the Honorable Cecelia G. Morris.

On October 10, 2003, schedules of creditors were filed pursuant to Bankruptcy Rule 1007 and the Local Rules of the Bankruptcy Court for the Southern District of New York. Any creditor holding a scheduled claim that is not listed as disputed, contingent or unliquidated as to amount may, but is not required to, file a proof of claim or interest in these cases. Creditors whose claims are either (i) not scheduled, (ii) scheduled inaccurately or, (iii) whose claims are listed as disputed, contingent, or unliquidated as to amount and who desire to participate in the cases or share in any distribution must file their proofs of claim. A creditor who desires to rely on the schedule of creditors has the responsibilty for determining that the claim is listed accurately.

The deadline set by the Bankruptcy Court for filing proofs of claim was March 19, 2004. Creditors holding any claim against a Debtor that arose prior to September 5, 2003, were required to deliver a completed and signed original proof of claim, together with accompanying supporting documentation, if by mail, to United States Bankruptcy Court, Southern District of New York, The Garden City Group, Inc. (as Claims Agent for Mercy), Bowling Green Station, P.O. Box 5037, New York, NY 10274-5037, or by hand delivery or overnight courier, to United States Bankruptcy Court, Southern District of New York, The Garden City Group, Inc. (as Claims Agent for Mercy), 176 Church Street, Poughkeepsie, New York 12601. All claims were to be sent by mail, hand delivery or overnight courier, so as to be received by the Bankruptcy Court no later than 5:00 p.m. Eastern Time on March 19, 2004. The Debtors mailed a Proof of Claim form, along with a Notice of Bar Date, to all known creditors.

You will not be able to obtain copies of the documents by calling the Court directly.
