On April 1, 2008, Diamond Glass, Inc. and DT Subsidiary Corp. (the "Debtors") filed voluntary petitions for reorganization under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the "Bankruptcy Court"). The cases are assigned to the Honorable Christopher S. Sontchi.
Pursuant to an order dated July 16, 2008, (the "Bar Date Order"), the Bankruptcy Court set September 8, 2008 at 4:00 p.m. prevailing Eastern Time (the "General Bar Date") as the last date to file a claim against the Debtors for any debt that arose prior to April 1, 2008. The Bar Date Order set September 29, 2008 at 4:00 p.m. prevailing Eastern Time (the "Government Bar Date") as the last date for a governmental unit to file a claim against the Debtors for any debt that arose prior to April 1, 2008.
On August 15, 2008, the Debtors filed their Chapter 11 Plan of Liquidation and accompanying Disclosure Statement. On September 17, 2008, the Debtors filed their First Amended Chapter 11 Plan of Liquidation and their First Amended Disclosure Statement. On September 22, 2008, the Debtors filed their Second Amended Chapter 11 Plan of Liquidation and their Second Amended Disclosure Statement. Following a hearing held on September 19, 2008 to consider approval of the Second Amended Disclosure Statement, an order was entered by the Bankruptcy Court on September 24, 2008 approving the Second Amended Disclosure Statement and scheduling a hearing on confirmation of the Debtors' Second Amended Chapter 11 Plan of Liquidation (the "Confirmation Hearing") for October 30, 2008 at 10:00 a.m. The Confirmation Hearing has subsequently been adjourned to December 1, 2008 at 10:00 a.m.
Moreover, on August 15, 2008, an order was signed by the Bankruptcy Court amending the caption of this case to reflect the Debtors' name change to DG Liquidation Corp., et al.
